These Terms of Service (“Terms”) govern your access to and use of Staticflow LLC’s (“Staticflow,” “we,” “us”) websites and the messaging assistants (“chatbots”) we operate on Facebook Messenger, Instagram, and website chat, including assistants operated on behalf of our business clients (the “Services”). By using the Services, you agree to these Terms.

1. The service

Our assistants help answer questions, qualify inquiries, and schedule appointments or follow-ups, with handoff to a human agent where appropriate. Replies may be generated by automated logic and AI models and may not always be accurate or complete; they are not professional, legal, financial, or medical advice. Confirm important details with a human before relying on them.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding agreement to use the Services.

3. Acceptable use

You agree not to:

Use the Services for unlawful, harmful, deceptive, or abusive purposes.
Send spam, malware, or attempt to disrupt, overload, or reverse-engineer the Services.
Submit content that infringes others’ rights or violates applicable law or platform policies.
Attempt to gain unauthorized access to any system, account, or data.

4. Third-party platforms

The Services operate on third-party platforms (including Meta’s Messenger and Instagram). Your use of those platforms is also governed by their terms and policies. We are not responsible for third-party platforms, and platform availability or changes may affect the Services.

5. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms. You can request deletion of your data at staticflow.ai/data-deletion.

6. Intellectual property

The Services, including our software, content, and marks, are owned by Staticflow or our licensors and are protected by law. We grant you a limited, non-exclusive, revocable license to use the Services for their intended purpose. You retain rights to content you submit and grant us a license to use it to provide and improve the Services.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that AI-generated responses will be accurate.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATICFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. Our total liability for any claim is limited to the amount you paid us (if any) for the Services in the 12 months before the claim.

9. Indemnification

You agree to indemnify and hold Staticflow harmless from claims and expenses arising out of your misuse of the Services or violation of these Terms.

10. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

11. Governing law

These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in [jurisdiction]. [Confirm with counsel.]
